Gang stalking laws and the steps you need to take to prove your case in court

Is gang stalking prohibited by law? Yes, it may not be described as “gang stalking” per se, but the law does not allow the methods and tactics that perpetrators use against their victims or targets.

Find various laws that gang stalkers violate. This information is not offered as legal or prescriptive advice and you should verify the specificity of local laws. Your state statutes should provide provisions similar to those provided in this document.

1. Federal Law RICO – 18 USC Chapter 96 if it is about extortion; there must be some kind of company, system or group of people doing illegal activities for profit.

2. Anti-Stalking Laws – Wisconsin Stat 940.32; you’d have to go after each individual stalker, which, as we know, is hard to do if the stalkers rotate and change, and if you can be bothered to get the police to take you seriously.

3. Harassment Laws – Wisconsin Statute 947.013; you would have to prove a “course of conduct” which means a pattern, or repeated acts that harass or intimidate a person and, a more serious subsection that can get the perpetrator(s) into more legal trouble is if you can demonstrate a “credible threat”, which means that an actual threat would have to be made against you. But you cannot file a private cause of action, in short, you cannot obtain damages (receive monetary compensation) for the harassment.

4. Conveyance to land – Wisconsin Stat. 943.13. Even if you are a tenant of a property and did not give permission for someone to be on your property, you still qualify. This statute can help if you can actually show trespass, such as stalkers actually trespassing on private property or placing spy or surveillance equipment on the land.

5. Illegal entry to the person/

Assault, Aggression, False Prison.

Battery – Wisconsin Stat 940.19, you must prove bodily harm without your consent.

False Imprisonment – Wisconsin Stat 940.30, you must prove that someone you knew did not have the legal authority intentionally confined or restrained you without your consent.

6. Invasion of Privacy – Wisconsin Stat. 942.08; he would have to prove that a person entered a place where he would expect privacy, or entered private property, and watched him or installed a surveillance device on that property.

7. Defamation – Wisconsin Stat 942.01; you would have to prove that someone communicated something to a third party, of a defamatory nature, that was untrue, without good reason, without justification, and without privilege (meaning that you did not consent to the communication and the person communicating the defamation I had no absolute privilege to do so.)

If the person can show that they have a conditional privilege to communicate the defamatory material, it may not be considered defamatory.

Slander, spoken defamation, requires the testimony of 2 other people who heard and understood the oral statement as defamatory. Libel is a written libel or published false statement.

Then people wonder what they have to do to prove they are being gang-harassed in court. The police and the “court system” may not be on your side and you may well have to do your own work on your case. He is looking to prove violations of the laws as stated above. So, have your evidence point in the direction of proving those violations.

A. Have people witness what you are experiencing so they can testify on your behalf in court.

B. Take a video camera with you wherever you go. Videotape the perpetrators and their actions against you. Keep getting more images. It’s best if you can show the SAME people who are harassing you or your family.

C. Maintain detailed written records and notes of gang stalking activity.

D. Take pictures of what is going on and what is going on with the bullying behavior.

E. Show your evidence to other people; friends, family, private detectives, lawyers.

F. Install hidden security cameras around your residence, your vehicle, your office.

G. Communicate with other survivors of gang, group or organized stalking. There are online groups and anonymous blogs that can offer you support.
